Terms of Use for RODY AI

Welcome to RODY AI, a mobile education application ("App") developed and operated by AI-R Metaverse Limited ("we," "us," or "our"), a company registered in Hong Kong. These Terms of Use ("Terms") govern your access to and use of the App, including all features, content, services, and subscriptions (collectively, the "Services"). By downloading, accessing, or using the App, you ("you" or "User") agree to be bound by these Terms and our Privacy Policy. If you disagree, you must not use the App. RODY AI is an AI-enhanced educational platform designed for children aged 4-17, offering animated stories with 3D AI characters, interactive chat features, augmented reality (AR) experiences, and a subscription model.

1. Acceptance of Terms

1.1 Agreement

Your use of the App constitutes acceptance of these Terms, forming a legally binding contract between you and AI-R Metaverse Limited. If accepting on behalf of a Child User (defined below), you represent that you are an adult with the authority to do so.

1.2 Updates

We may modify these Terms at any time. Updates will be posted on our website, in the App, or notified via email or in-app message, effective upon posting or as specified. Continued use after updates signifies acceptance of the revised Terms.

2. Eligibility and Account Management

2.1 Age and Users

Child Users: RODY AI is intended for children aged 4-17 ("Child Users"). Child Users may only use the App under the supervision and consent of an Adult User. Adult Users: You must be 18 or older (or have reached the age of majority in your country of residence, whichever is greater) ("Adult User") to create an account, purchase a Subscription (defined below), or provide consent for a Child User.

Only an Adult User may download, install, and create an account for the App. Child Users may not download, install, or register on their own. By creating an account, the Adult User represents and warrants that they (a) have reached the age of majority in their country of residence, (b) are downloading and using the App on their own initiative, and (c) authorise any Child User profile linked to their account.

2.2 Parental Consent

Adult Users allowing a Child User to access the App are responsible for their use, interactions, and compliance with these Terms. Adult Users should monitor the use rate of their Child Users' monthly quotas.

2.3 Account Responsibility

You must provide accurate information when creating an account and keep your login credentials confidential. You are liable for all activities under your account, including unauthorised use, unless caused by our negligence.

2.4 Verification

For Subscription purchases, we rely on the age verification and parental control settings provided by your device's operating system and the applicable app store. We implement reasonable measures to verify age where possible, but we cannot guarantee the accuracy of such data. You assume responsibility for any misuse. AI-R Metaverse Limited does not knowingly collect personal data from children under 18 without verified parental consent. If we learn that a Child User has created an account or subscribed without verifiable parental consent, we may suspend or terminate the account and delete associated data as required by law.

2.5 Geographic Scope

AI-R Metaverse Limited is incorporated in and operates from Hong Kong. We do not actively market, solicit, or offer the App for sale to users outside Hong Kong. The App is made available globally on Apple App Store and Google Play as a convenience; if you choose to download or use the App from another country, you do so on your own initiative and accept that the laws of that country may apply to your use of the App. Where mandatory consumer or data-protection laws of your country of residence grant you rights stronger than these Terms, those local rights apply to the extent of any conflict.

3. Subscriptions and Payments

3.1 Subscription Plan

The App offers optional subscription plans ("Subscriptions") for premium features, such as additional stories, enhanced AI interactions, and AR experiences. The Subscription includes access to premium content, a monthly quota for high-quality character voices, a monthly quota for creating AI-generated content, and a monthly quota for accessing premium learning tools. Subscription details (fees, billing cycles, features) are provided in the App at the time of purchase.

3.2 Payment Authorisation

You authorise us to charge your selected payment method for Subscription fees, including applicable taxes. Payments are processed through third-party providers (e.g., app stores), subject to their terms and conditions.

3.3 Auto-Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date via the App or your app store account. You remain liable for fees until cancellation is effective.

3.4 Non-Refundable

Except as required by law or specified in our refund policy, Subscription fees are non-refundable. Refund requests are primarily handled in accordance with the refund policies of the applicable app store (Apple App Store or Google Play Store) — typically up to 90 days after purchase for Apple, and as permitted by Google Play's terms. If you believe a Child User made an unauthorised purchase, please first request a refund through the relevant app store. You may also notify us at support@rodyssey.ai with supporting evidence; we may, in our sole discretion, refund the purchase if it is verified as unauthorised and the app store has declined the request.

3.5 Price Changes

We may adjust Subscription fees with prior notice. Changes apply to your next billing cycle unless otherwise stated.

3.6 Free Trials

If offered, free trials convert to paid Subscriptions unless cancelled before the trial ends. Only one trial per user or payment method is permitted.

3.7 Quotas and Limitations

When a monthly quota is reached, the account will not be able to access the related aspect, but you may still use the remaining elements in accordance with the specific quota type and the free character voices.

3.8 Parental Responsibility for Purchases

The Adult User account holder is solely responsible for all purchases made on their account, including any purchases made by Child Users with access to the device. We strongly recommend that Adult Users:

  • Enable "Ask to Buy" via Apple Family Sharing or Google Play Family Library;
  • Set a Screen Time / Digital Wellbeing passcode required for in-app purchases;
  • Do not share device passcodes with Child Users;
  • Sign out of the App Store / Google Play Store on shared devices when not in use.

While the relevant app store may, in its sole discretion, refund unauthorised purchases in accordance with its own policies, we are not responsible for purchases made due to inadequate parental supervision of the device or account.

3.9 Consumed Services and Third-Party Costs

Subscription fees include access to AI services that incur real-time costs to us from third-party providers (including OpenRouter and Google Gemini) at the moment of use. These costs are non-recoverable by us once the AI request is processed.

Accordingly, where we exercise discretion to issue a refund directly (i.e. outside of the app store's mandatory refund process), we may deduct from any refund the value of AI services already consumed during the subscription period, calculated on a pro-rata basis with reference to:

  • The number of AI chat messages generated;
  • The number of voice and image AI requests processed;
  • The proportion of monthly quota used.

Where the relevant app store (Apple or Google) issues a refund directly to the user, we have no contractual right to recover from the user the cost of AI services already consumed. However, repeated patterns of post-consumption refund requests may, at our discretion, result in account suspension or termination under Section 9.2.

3.10 Changes to the Services

We may add, modify, suspend, or discontinue features, content, characters, quotas, or any other part of the Services as the App develops. For any material reduction that affects an active paid Subscription, we will give you reasonable prior notice and, where required by law, the option to cancel with a pro-rata refund of the unused portion of your Subscription. We will not reduce the core features described at the time of your purchase during your then-current billing cycle without such notice.

3.11 Promotions and Redemptions

From time to time we may offer promotions, free trials, referral rewards, or redemption codes (including "friends and family" offers). Each promotion is subject to the specific terms — including eligibility, quantity, value, and validity period — stated at the time the offer is made. We may vary, limit, or withdraw any promotion for future redemptions at our discretion, but we will honour valid redemptions already made in accordance with the stated terms. Promotions have no cash value, are not transferable unless stated, and may not be combined with other offers unless expressly permitted.

4. Licence and Use of the Services

4.1 Limited Licence

We grant you a revocable, non-exclusive, non-transferable, non-sublicensable licence to use the App and Services for personal, non-commercial purposes, subject to these Terms.

4.2 Permitted Use

You may:

  • Access educational content, including animated stories and 3D AI characters.
  • Engage in chat sessions with AI characters for learning.
  • Use the AR feature on your device's camera to capture real-world environments and interact with AI characters to learn about the objects or scenes you capture.

4.3 Prohibited Conduct

You must not:

  • Copy, modify, distribute, or create derivative works of the App or its content.
  • Use the App for illegal, harmful, fraudulent, or commercial purposes.
  • Infringe intellectual property rights, including ours or third parties.
  • Interfere with the App's functionality (e.g., hacking, reverse-engineering, or overloading servers).
  • Input offensive, inappropriate, or harmful content into AI chat features.
  • Circumvent access controls, age verification, or security measures.
  • Use the AR feature in unsafe environments, such as while driving, operating machinery, or in situations where distraction could cause harm.
  • Capture or share images of individuals without their consent, or capture sensitive locations or information via the AR feature.
  • Scan people or faces using the AR feature.
  • Scan in bathrooms or changing rooms using the AR feature.
  • Scan while moving (e.g., walking, running, on stairs, or crossing streets) using the AR feature.
  • Scan for potential hazards (e.g., roads, stoves, kitchens, or water) using the AR feature.
  • Scan where cameras are not allowed (e.g., classrooms, museums, or areas with no-photo signs) using the AR feature.
  • Scan near edges (e.g., during hiking or near windows) using the AR feature.
  • Scan house numbers near your home using the AR feature.
  • Scan screens, bills, or family photos using the AR feature.
  • Scan pets up close using the AR feature.
  • Scan inside a moving vehicle using the AR feature.
  • Scan a credit card using the AR feature.
  • Scan during bad weather using the AR feature.

Violation may result in immediate termination of your access without notice.

4.4 AI and AR Features

Our AI characters and AR experiences are designed to provide educational, age-appropriate responses and interactions. However:

  • AI-generated output, including responses based on AR-captured images, may not be accurate, complete, or predictable.
  • You are responsible for evaluating the accuracy and appropriateness of AI-generated content before using or sharing it.
  • AI responses are generated dynamically based on user input, available data, and AR captures. Whilst we strive to ensure appropriate, educational, and safe interactions, we do not guarantee the accuracy, reliability, or appropriateness of AI responses. Users acknowledge and accept the inherent risks of AI-based interactions. AI-R Metaverse Limited is not liable for any unintended, misleading, or inappropriate AI responses.
  • The AR feature requires access to your device's camera and may process images of the real world. You agree to use the AR feature responsibly and in compliance with applicable privacy laws. We process AR-captured data solely for providing the educational interaction and do not store images unless necessary for service improvement, as detailed in our Privacy Policy.
  • You agree to supervise Child Users' interactions with AI and AR features to ensure safety and suitability for their age. We are not liable for AI-generated content, AR interactions, or any risks associated with real-world capture beyond our reasonable control, including physical safety risks arising from the use of AR.
  • We are not liable for any hallucinations, biases, or errors inherent in AI technology used in the App.
  • Children under 8 years of age must be supervised by an Adult User at all times when using AR features, and such children should only use AR features in safe, indoor environments. Adult Users assume responsibility for any harm arising from unsupervised AR use by children under 8.

5. Intellectual Property

5.1 Our Rights

All content, software, AI technology, 3D characters, designs, trademarks, AR functionalities, and other materials in the App ("Our Content") are owned by AI-R Metaverse Limited or our licensors, protected by copyright, trademark, patent, and other intellectual property laws worldwide.

5.2 User Content

Any data or input you provide (e.g., chat messages, feedback, AR-captured images) ("User Content") remains yours. You grant us a worldwide, royalty-free licence to use, store, modify, and analyse User Content for the duration necessary to operate, improve, and promote the Services, in accordance with our Privacy Policy. This licence terminates when you delete the relevant User Content or delete your account, except for de-identified, aggregated data already used for service improvement, which may be retained in anonymised form.

5.3 Feedback

Suggestions or feedback you provide about the App are voluntary and become our property, with no obligation to compensate you.

5.4 Restrictions

You may not use Our Content outside the App, claim ownership, or challenge our intellectual property rights. Report violations to support@rodyssey.ai.

6. Privacy and Security

6.1 Data Protection

AI-R Metaverse Limited processes personal data primarily under Hong Kong's Personal Data (Privacy) Ordinance (PDPO), and in accordance with any other data protection laws of the user's country of residence to the extent they mandatorily apply. Parents and guardians must provide verifiable consent before we collect personal data from Child Users under 18, including any data captured via AR features. If you believe a Child User has provided data without proper consent, contact us at support@rodyssey.ai. We adhere to data minimisation principles, collecting and retaining only the personal data necessary for the purposes described in our Privacy Policy.

6.2 Children's Privacy

Adult Users consent to the collection of Child Users' data as described in the Privacy Policy. This includes data from AR captures, which may involve images of the environment. We implement safeguards, but Adult Users must supervise and report issues.

6.3 Security

We use reasonable measures to secure the App, but no system is immune to breaches. Notify us promptly of any unauthorised account access at support@rodyssey.ai. In the event of a data breach involving personal data, we will notify affected users within 72 hours if the breach is serious, in accordance with applicable laws.

7. Safety and Supervision

7.1 Safe Environment

We aim to provide a safe, educational experience. Adult Users must monitor Child Users and ensure their interactions, including AR use, align with these Terms. AR features may pose physical risks, such as distraction leading to accidents; use only in safe, controlled environments. We provide an optional lesson within the App that educates users on AR safety and ethics, including key "don'ts" for AR usage. Adult Users are responsible for educating Child Users about these guidelines and ensuring compliance. We are not liable for any accidents, injuries, damages, or losses arising from the use of the App, including the AR feature.

If a Child User indicates distress, thoughts of self-harm, or any mental-health crisis during interaction with the App, Adult Users should immediately seek professional support. The following Hong Kong helplines are available:

The App and its AI features are not designed for crisis intervention and should not be relied upon in any emergency or mental-health crisis.

7.2 Reporting

Report inappropriate AI responses, AR content, or technical issues to support@rodyssey.ai. We may investigate, but are not obliged to resolve every report.

7.3 No Moderation Guarantee

We do not pre-screen all AI interactions or AR captures and cannot guarantee real-time moderation. You use the App at your own risk.

8. Third-Party Services

8.1 External Links

The App may include links to third-party websites or services (e.g., payment processors, app stores). We are not responsible for their content, terms, or practices.

8.2 App Stores

Downloads and purchases via app stores (e.g., Apple App Store, Google Play) are subject to their terms, which supplement these Terms. By using the App, you also agree to the applicable terms of Apple (https://www.apple.com/legal/internet-services/itunes/) and Google (https://play.google.com/about/play-terms/), which are incorporated herein by reference. Apple and Google are third-party beneficiaries of these Terms and may enforce them against you with respect to their respective platforms.

9. Termination and Suspension

9.1 By You

You may stop using the App and delete your account at any time via the App's settings.

9.2 By Us

We may suspend or terminate your access, account, or Subscription—at our sole discretion and on reasonable grounds—with or without notice, for reasons including:

  • Violation of these Terms.
  • Suspected fraud, abuse, or illegal activity.
  • Failure to comply with age restrictions.
  • Misuse of AI or AR interactions, including violation of AR safety guidelines or "don'ts".
  • Non-payment.
  • Intellectual property or privacy rights violations.
  • A pattern of post-consumption refund requests (i.e. requesting refunds via the app store after substantial use of AI services within the subscription period), suggesting abuse of the refund mechanism.
  • Technical, security, or legal requirements. If your account is suspended or terminated, you may appeal the decision by contacting us at support@rodyssey.ai within 30 days, providing reasons and evidence for reconsideration. We will review appeals in good faith, but are not obliged to reverse the decision.

9.3 Effect

Upon termination, your licence ends, and unpaid fees remain due. Prepaid Subscription fees are non-refundable unless required by law.

10. Disclaimers

10.1 As-Is Basis

The App and Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

10.2 No Guarantee

We do not warrant that:

  • The App will be uninterrupted, error-free, or secure.
  • AI responses or AR experiences will be accurate, appropriate, or free of defects.
  • The Services will meet your expectations.

10.3 Risk

You assume all risks related to your use, including data loss, device damage, privacy risks from AR captures, physical injury from AR use, or reliance on AI-generated content. We are not liable for any accidents, injuries, property damage, or other losses arising from the use of the App or Services, including, but not limited to, those caused by distraction, unsafe environments, or failure to follow safety guidelines.

11. Limitation of Liability

11.1 Exclusion

To the fullest extent permitted by law, AI-R Metaverse Limited, its affiliates, officers, directors, employees, and licensors are not liable for any indirect, incidental, special, consequential, or punitive damages (e.g., loss of data, profits, or goodwill) arising from your use of the App or Services, including any issues related to AR features, accidents, injuries, or property damage.

11.2 Cap

Our total liability, if any, is limited to the greater of HKD 1,000 or the amount you paid us for the Subscription in the 12 months preceding the claim.

11.3 Exceptions

Nothing in these Terms excludes liability for fraud, wilful misconduct, death or personal injury caused by our negligence, or any other matter that cannot be excluded or limited under Hong Kong law or under any mandatory law of the user's country of residence.

12. Indemnification

12.1 Your Obligation

You agree to indemnify, defend, and hold harmless AI-R Metaverse Limited and its affiliates from any claims, losses, or damages (including legal fees) arising from:

  • Your wilful violation of these Terms or prohibited conduct.
  • Your or a Child User's use of the App, including AR features.
  • Your User Content willfully infringes on intellectual property or privacy rights.
  • Any wilful breach of applicable laws or third-party rights.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region ("Hong Kong"), without regard to conflict of law principles. Please note that some countries have mandatory consumer-protection laws that require agreements to be governed in part by the local laws of the consumer's country of residence. Nothing in this section overrides those mandatory local laws where they apply to you.

13.2 Dispute Process

Disputes will first be addressed through good-faith negotiation. If unresolved within 30 days, they will be submitted to binding arbitration under the rules of the Hong Kong International Arbitration Centre (HKIAC), administered by HKIAC in Hong Kong. A single arbitrator shall conduct the arbitration, and the decision shall be final and binding. If arbitration is not applicable, disputes will be submitted to the exclusive jurisdiction of the Hong Kong courts.

13.3 Class Action Waiver

You waive any right to participate in class actions, class arbitrations, or representative actions against us related to these Terms or the Services.

13.4 Application to Adult Users Only

For the avoidance of doubt, the arbitration agreement in Section 13.2 and the class-action waiver in Section 13.3 bind only the Adult User account holder. Child Users are not parties to these arbitration or waiver provisions and retain any non-waivable rights available to minors under Hong Kong law.

14. Copyright Complaints

We respect intellectual property rights. We may terminate, in appropriate circumstances, accounts of users who are deemed to be repeat infringers.

If you believe content available through the App infringes your copyright, you may submit a notice of alleged infringement to:

Your notice should include:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material that is claimed to be infringing and information sufficient to permit us to locate the material.
  • Your contact information (mailing address, telephone number, and email address).
  • A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and that you are authorised to act on behalf of the copyright owner.
  • Your physical or electronic signature.

15. Export and Sanctions Compliance

You may not use or otherwise export or re-export the App in violation of any applicable export control or economic sanctions laws. By using the App, you represent and warrant that you are not located in any country or on any list that would prohibit your access to the App under applicable law.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with the Privacy Policy and any in-app notices, constitute the whole agreement between you and us regarding the App. These Terms supersede and exclude any prior representations, understandings, or agreements, whether oral or written.

16.2 Severability

If any provision is found unenforceable, the remaining Terms remain in effect.

16.3 No Waiver

Our failure to enforce any right does not waive it.

16.4 Assignment

We may assign these Terms or delegate duties without your consent. You may not assign your rights without our written approval.

16.5 Force Majeure

We are not liable for delays or failures caused by events beyond our control (e.g., natural disasters, pandemics, cyberattacks, regulatory changes, or supply chain disruptions).

16.6 Language

These Terms are in English. Translations, if provided, are for convenience; the English version governs.

16.7 Maintenance

We may perform regular maintenance, updates, or hot fixes to the App, during which the server may enter maintenance mode, and you may not be able to access the App until the maintenance is completed. We will notify users in advance of planned maintenance whenever possible and to minimise downtime. By using the App, whether as a subscription user or a free user, you agree to such maintenance activities and agree not to request any partial or full refund for any temporary loss of access during maintenance periods.

16.8 Tax and Compliance

You are responsible for any taxes, duties, or levies applicable to your use of the Services, including any value-added tax or goods and services tax. We comply with applicable anti-money laundering and counter-terrorism financing laws, and you agree to provide any information required for such compliance.

16.9 Overseas Disclaimer

Users outside Hong Kong acknowledge that the laws of their country of residence may apply to their use of the App. Where there is a conflict between these Terms and a mandatory law of the user's country of residence, that mandatory law prevails to the extent of the conflict.

16.10 Data Breach Indemnity

You agree to notify us promptly of any suspected data breach or security incident related to your account. You will indemnify us against any claims arising from incidents caused by your negligence or wilful misconduct.

16.11 Experimental Features

We may add or remove any experimental features or content at our discretion. We will share related updates on our website, in the App, or notify via email or in-app message, effective upon posting or as specified. These experimental features or content are outside the scope of the standard Services.
